Consultation of the website implies that the user accepts in full, and undertakes to comply with, the terms of use set out below.
Preamble
Firstly, the internet user agrees to use the Website content for his/her own personal use only and not for any commercial purposes. In the event of non-compliance by the internet user with the provisions of this Charter, his/her civil or criminal liability may be engaged.
The sale of alcohol to minors being prohibited, the internet user declares on his/her honour that he/she is over the age of 18 years at the time of purchase.
Website content
The Website is operated by 10-Vins. It does not allow internet users to order wine but aims to promote the D-Vine system among professionals.

Intellectual property rights
The Website comprises works of which 10-Vins is the author as defined under
Article L111.1 and ensuing articles of the French Intellectual Property Code. 10-Vins is a French brand which was registered at the INPI (national patent office) on 17th December 2012 under reference no. 3969400. Any reproduction, use or affixing of the said brand without the prior consent of 10-Vins is forbidden, in accordance with the provisions of Article L713-2 of the French Intellectual Property Code. It should be noted that the photographs present on the Website are considered as intellectual works and are protected as such under copyright law. Any unauthorised use of such photographs will be considered as counterfeiting and punishable under Article L335-3 of the French Intellectual Property Code.
As a general rule, the data, programmes, musical extracts, texts, information, logos, corporate identity items, still and animated images present on the Website, as well as any formatting applied thereto, are the property of 10-Vins and are protected as such under the provisions of the French Intellectual Property Code. The internet user promises not to use this content nor to allow anyone else to use it for any illegal purpose.
Any digital or printed representation or reproduction, in full or in part, be it permanent or temporary, carried out by whatever procedure (including framing*), of any of the Website items or proposed services without the prior explicit consent of 10-Vines, is forbidden and would be considered as counterfeiting, an act which is punishable under civil and/or criminal law. Only paper printouts for the exclusive private use of the copier, as defined under Article L122-5 Clause 2 of the French Intellectual Property Code, are authorised.
Hyperlinks to the Website may not be used without the prior explicit consent of 10-Vins.
* Framing: the act of retrieving web page content to include in one’s own website by means of a hyperlink and making such content appear to be one’s own.
Protection of personal data
1. Mandatory and optional input
The internet user may visit the Website without being identified or providing any personal information. However, to obtain any additional information, the internet user must register, in which case, he/she will be asked to provide his/her surname, first name and email address.
2. Purpose of processed data
The input of this data is required in order to allow 10-Vins to process the internet user’s query and provide access to the various wine-tasting videos. Besides this information, statistical tools may store IP addresses and other details used to generate statistics about use of the Website. An IP address is merely a number allocated automatically to the internet user’s computer by the internet provider. The internet user may at any time exercise his/her right to access, rectify, query or oppose the information provided during the registration process, or at a later date, by writing to 10-Vins at the following address: 10-Vins, 16 ter Boulevard de la Prairie au Duc, 44200 Nantes, France, or by sending an e-mail to: contact@10-vins.com.
3. Data management
10-Vins undertakes to comply with the provisions of the modified Act no. 78-17 dated 6th January 1978 relating to data protection and freedom of information, and to take all necessary precautions to safeguard the confidentiality of any personal information held. No personal information will be passed on to third parties without the prior and informed consent of the internet user.
Cookies
A cookie is a text file deposited on the internet user’s hard drive by the server of the visited website. It does not, however, allow the internet user to be identified. It merely generates a random number under which information is registered. Temporary cookies are deleted from the internet user’s computer when the browser is closed. Permanent cookies remain in the internet user’s computer memory after the browser is closed, for a period of 6 months.
Cookies are used by 10-Vins to facilitate electronic messaging and are absolutely necessary for the provision of an online communication service. In this case, the internet user’s permission to use them is not required. However, the internet user may oppose the depositing of cookies by changing his/her browser settings, as follows:

Liability
10-Vins declines responsibility for any malfunctions occurring on the Website and causing loss of data or the impossibility to access information generated by the Website. Items presented on the Website are liable to change without prior notice and are made available to internet users without any explicit or implicit guarantee whatsoever.
The presence of hyperlinks on the Website – with or without the prior agreement of 10-Vins – does not imply shared liability, between 10-Vins and the owners of the websites concerned, for the web content to which the internet user is guided. 10-Vins cannot guarantee the exhaustive nature or the veracity of information presented on the Website, nor can it guarantee the absence of modifications by third parties, such as hackers or viruses.
Furthermore, the internet user is responsible for the way in which he/she uses the Website content. Except in the event of serious misconduct by 10-Vins alone, the latter shall not be held liable for any direct or indirect prejudice relating to the use of information produced on the Website.
Modification
10-Vins reserves the right to modify these terms of use, at any time and without prior warning, in order to allow for the Website’s developments and/or any operating changes.
Applicable law and Competent jurisdiction
All information published on the Website and any use of such information is subject exclusively to French Law. Any disputes arising from use of the Website shall be handled exclusively by tribunals falling under the jurisdiction of the Court of Appeal of Rennes.

Social media
For social media, the Website uses extension modules, known as “plugins”. When the internet user interacts with the Website via plugins, information relating to his/her browsing behaviour is stored on the server of the social network operator concerned, and is shared in accordance with the account settings of the social network user, as defined under that social network’s terms of use. In any event, the use of plugins is governed exclusively by the terms and conditions of use that define the relationship between the internet user and the social network with which he/she is registered.
